Terms of Service

Welcome to tamararodriguez.com and the Tamara Rodriguez mobile app (collectively, the "Service"), operated by Cardno ("we", "us", "our"). By accessing or using the Service you agree to be bound by these Terms of Service (the "Terms"). If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account, applying to the Indigo Collective, or using any feature of the Service you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. We may update these Terms from time to time. We will notify you of material changes through the Service or by email and will update the "Last updated" date.

2. Eligibility

You must be at least 13 years old to create an account and at least the age of majority in your jurisdiction to enter into a binding contract. If you are between 13 and 18 you may use the Service only with permission from a parent or legal guardian.

3. Your Account

You are responsible for maintaining the security of your account and password. You must provide accurate information and keep it up to date. You are responsible for all activity that occurs under your account. If you believe your account has been compromised, contact us immediately at tamara@tamararodriguez.com.

4. Member Content

Members of the Indigo Collective may post profile information, photographs, performances, comments, and messages ("Member Content"). You retain ownership of your Member Content. By posting it you grant us a worldwide, non-exclusive, royalty-free licence to host, display, reproduce, distribute, and adapt that content as necessary to operate, promote, and improve the Service. You represent that you own or have all necessary rights to the content you post.

5. Prohibited Conduct

You agree not to use the Service to: (a) post objectionable, hateful, harassing, sexually explicit, violent, or unlawful content; (b) impersonate any person or misrepresent your affiliation; (c) infringe any intellectual property, privacy, or other right; (d) upload viruses, malware, or other harmful code; (e) collect data about other users without consent; (f) circumvent moderation or block systems; (g) use the Service for spam or unsolicited commercial messages. We have a zero-tolerance policy for objectionable content and abusive members and will remove offending content and terminate offending accounts.

6. Moderation, Reporting and Blocking

We provide tools to flag content and members. Every report is reviewed within 24 hours and we will remove content or terminate accounts that violate these Terms or our Community Guidelines. You may also block any other member at any time, which prevents them from messaging you and hides their content from your feed.

7. Suspension and Termination

We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms, the Community Guidelines, or applicable law. You may delete your account at any time from the Settings screen of the mobile app or by contacting us at tamara@tamararodriguez.com. Deletion is permanent and removes your profile, posts, comments, conversations, and performances.

8. Purchases and Tickets

Tickets, music, and other paid items are sold by third parties (such as ticket vendors, Bandcamp, or Spotify). Their terms and refund policies apply to those purchases. We do not currently sell digital subscriptions through the app.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, in no event shall Cardno, Tamara Rodriguez, or our licensors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or in connection with your use of the Service.

11. Governing Law

These Terms are governed by the laws of the United Kingdom, without regard to conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the courts located in London, United Kingdom for any dispute arising out of or relating to these Terms.

12. Changes to the Service

We may add, modify, or discontinue features at any time. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.
